You represent and warrant that you own or have the necessary rights to the User-Generated Content you submit and that such content does not infringe upon the rights of any third party. Xerochrysum reserves the right to remove any User-Generated Content that violates these Terms or is otherwise objectionable at our sole discretion.

By submitting User-Generated Content, you acknowledge that you are solely responsible for such content and any consequences of submitting it. Xerochrysum is not responsible for any User-Generated Content and does not endorse any opinions expressed in such content.

7. Payment Terms

Access to certain features of our services may require payment of fees. By subscribing to our services, you agree to pay all applicable fees as outlined on the Site. All fees are non-refundable unless otherwise stated. You are responsible for providing accurate billing information and for ensuring that your payment method is valid and up to date.

We reserve the right to change our pricing at any time, but any changes will not affect your current subscription until the end of your billing cycle. If you do not agree to the new pricing, you may cancel your subscription before the new pricing takes effect.

In the event of a payment dispute, you agree to contact us directly to resolve the issue. We reserve the right to suspend or terminate your access to the services if we do not receive payment for any fees owed.

In no event shall Xerochrysum’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, Xerochrysum’s liability shall be limited to the fullest extent permitted by law.

10. Termination

These Terms are effective until terminated by either party. You may terminate these Terms at any time by discontinuing your use of the services and deleting your account. Xerochrysum may terminate or suspend your access to the services immediately, without prior notice or liability, if you breach these Terms or if we believe that your conduct poses a risk to Xerochrysum or any third party.

Upon termination, your right to use the services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination of these Terms shall not affect any rights or obligations that have accrued prior to the date of termination.
